Foreign Accounts (Form 3916)
Every French tax resident is required to declare the following types of foreign accounts and contracts annually using Form 3916-3916 bis. This obligation applies to any account opened, held, used, or closed abroad during the tax year, regardless of the balance.
Foreign Bank Accounts: Current (checking) accounts. Standard savings accounts. Foreign-specific tax-efficient accounts (e.g., UK ISAs). Accounts for which you simply have power of attorney (procuration).
Foreign Securities / Investment Accounts: Brokerage accounts used for trading shares, bonds, or other financial instruments. Portfolio management accounts.
Foreign Digital Asset Accounts: Accounts held with any platform (e.g., crypto exchanges) that receives digital values in deposit. Accounts holding crypto-currencies or digital tokens.
Foreign Life Insurance & Capitalization Contracts: Assurance-vie policies (e.g., UK Investment Bonds). Capitalization contracts held with non-French insurers.
Rules and Exclusions No Minimum Balance: You must declare the account even if it has a zero balance or contains only a very small amount of money. Inactive Accounts: Even if the account was not used during the year, it must be reported as long as it remains open. Annual Requirement: The 3916 declaration is not a one-time event; it must be repeated every year that the account exists. Joint Accounts: Accounts held jointly or those where you have power of attorney are included in the declaration obligation. French Branches: You do not need to declare accounts held with a foreign bank if they are managed through their French branch network (which provides a French IFU).
